By accessing or using PaintMory (the "Service"), you agree to be bound by these Terms of Service, our Privacy Policy and our Refund Policy. If you do not agree, do not use the Service. The Service is intended for users aged 18 and older.
PaintMory transforms personal photographs into printable paint-by-number templates, colored-pencil guides and coloring pages (digital content), and offers custom physical paint-by-number kits made from your photos.
You must provide accurate information when creating an account. Subscription plans are billed on a recurring basis (monthly or annual). Your payment method is verified at signup but not charged during the free trial period. Cancellation takes effect at the end of your current billing period; you retain access until then. Founding Member pricing is locked as long as your subscription remains continuously active.
Free previews (low-resolution, watermarked) do not consume credits. A credit is consumed when you unlock a final, unwatermarked, print-ready output. If generation fails, the credit is automatically reversed. Once unlocked, re-downloads are free. Monthly subscription credits carry over up to a maximum balance of 20 credits. Extra credit packs expire 12 months after purchase.
Unlocked digital outputs are delivered immediately. By creating an account and by unlocking any output, you expressly request that delivery of digital content begins immediately, and you acknowledge that you thereby lose any statutory right of withdrawal or cancellation for that digital content once delivery has begun (including under EU Directive 2011/83/EU, Art. 16(m), and equivalent consumer laws). Because every preview is free and watermarked, you always see what you are buying before a credit is used. Details are set out in our Refund Policy.
You retain ownership of photos you upload. You confirm you have the right to use them and that they do not infringe the rights of any third party. PaintMory processes images solely for delivering the Service, including transmitting them to our production partner when you order a physical kit. We do not sell your images, use them for advertising, or use them to train AI models. Uploaded images are deleted 30 days after account deletion.
You may not upload illegal, harmful or infringing content; use the Service for bulk commercial reproduction without written permission; attempt to circumvent credit consumption, billing or watermarking; or interfere with the operation or security of the Service.
Custom kits are made to order from your photo. Payment is processed by us through Stripe; production and shipping are handled by our manufacturing partner. Because each kit is personalized, kit orders are non-refundable once production has started; damaged or defective kits are replaced as described in our Refund Policy. Shipping Protection, where purchased, provides replacement (not refund) for damaged, lost or stolen shipments.
We strive for accuracy but do not warrant that all information on the Service is complete, current or error-free. Prices and features of the Service may change; changes do not affect the price lock described in Section 3. We may modify or discontinue parts of the Service with reasonable notice.
The Service is provided "as is" and "as available". We do not guarantee that every photo will produce optimal results, which is why we provide quality scoring and free previews before any credit is consumed. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months preceding any claim. Nothing in these terms excludes liability that cannot be excluded by law.
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or your violation of any law or third-party right, including image rights in photos you upload.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature survive termination (including Sections 5, 10 and 11) survive.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected.
We may update these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
